RECURSO CONTRA LA DENEGACIÓN DEL ARRAIGO SOCIAL

¿Qué es el arraigo social? Se trata de una autorización de residencia temporal que podrá otorgarse en circunstancias excepcionales a ciudadanos extranjeros que se hallen en España y, tengan vínculos familiares en España o estén integrados socialmente

¿Qué requisitos se deben cumplir para solicitar dicha autorización? 

a) Estancia continuada de tres años en España.

b) No tener prohibida la entrada en espacio Schengen.

c) Tener un contrato de trabajo con una duración mínima de un año.

d) Carecer de antecedentes penales, tanto en España como en el país de origen.

e) Poseer vínculos familiares o en su defecto informe de inserción social.

¿Qué hacer si se deniega la solicitud? Existen dos vías en la legislación para recurrir: La vía administrativa (a través del recurso de Reposición), y la vía judicial.

El camino más fácil es el que nos ofrece el recurso de Reposición, ya que es gratuito y  también el más rápido. Para interponerlo, existe un plazo de un mes desde la notificación de la denegación. El recurso irá dirigido al órgano que dictó la denegación, si fue la Embajada o el Consulado, a ellos, o sino al Registro General de la Administración del Estado oportuno

¿En qué consiste el recurso? En pedirle al órgano en cuestión que rectifique su resolución, revisando el caso por si cometió algún error que invalidara la consecución de su visado o impidiera la obtención de su permiso. Si la respuesta que obtenemos vuelve a ser la misma, no quedará otra que acudir a la vía judicial, a través de recurso Contencioso Administrativo, siendo esta vez un Juez quien decida.

IMMIGRATION APPEALS

It is possible that immigration officials deny your visa, nationality, arraigo social, family reunification or residence permit renewal request.  What can you do if this happens?  You can submit an appeal for amendment (recurso de reposición) or take the case to trial.




What are the advantages to submitting an appeal?  

An appeal for amendment would be a much quicker route plus it doesn´t cost anything to submit one.

How long do you have to submit one?

You have one month from the date of the notification.  All you have to do is state your personal information, the file number, the grounds for refusal, arguments for why we think the decision was unjust along with evidence to prove it.

Where do you submit the appeal?

You may submit it at the Consulate or at any General Administration Registry of the State.  You may even send it by certified mail with proof of receipt.

To whom do you file the appeal?

You must file it to the same administrative body that denied your initial request so that they can rectify their decision.  If your appeal is once again rejected, then you can submit a Contentious-Administrative appeal.

A Contentious-Administrative appeal is a a judicial review of the case which is different from an appeal for amendment that is purely administrative.  You may submit a contentious administrative appeal within two months from the date of initial notification of rejection or, if you submitted an appeal for amendment, two months from the notification of rejection of that appeal.

It is ideal to go the administration route first before bringing it to trial to save both time and money.
