Being denied entrance at an airport is a very stressful situation to be in, which is why one should contact a lawyer who has experience dealing with customs and border control authorities in order to avoid deportation before being heard by a judge.



If the foreigner falls under one of the following categories, then it is understood that he is entering Spain illegally:


  • If the foreigner has been deported previously from the country
  • If the foreigner is subject to the international criminal court
  • If the foreigner is considered to be a threat to public policy, safety and public health
  • If the foreigner has not specified the purpose and conditions of travel

The entrance control officials may demand to see traveler documentation justifying the purpose of the trip.  Foreigners may choose any document that they see fit to justify their travel plans.  You must always present officials with your round trip ticket or tourist circuit.  


For business trips you must also present the following:

  • An invitation from a firm or authority inviting you to participate in trade, industry or work meetings related to the intended work activity.
  • Documentation illustrating the existence of business relations or links to the intended work activity.
  • Trade fair and Congress Center entry tickets.

For tourism or private trips, you may show the following:

  • Supporting lodging documentation during travels.  This must be issued by the accommodation establishment or in an invitation letter from an individual with which you will be staying during your trip.  The personal invitation letter (which may not take the place of the other mandatory entry requirement) must contain all relative information regarding accommodation and it must state that the host accepts full responsibility for invitee maintenance during the period of time specified in the letter.
  • Reservation confirmation of an organized trip (if applicable).  

For study or training trips you must also present supporting documentation of confirmed enrollment issued by the learning center. 

For other purposes of travel, you may present the following:

  • Invitiations, enrollments or programs.
  • Trip-related event participation certificates, entry cards or receipts.
