CERTIFICATE OF MATRIMONIAL CAPACITY

When foreign nationals decide to marry Spanish other foreign nationals, they must open a marriage file at the Civil Registry to review and monitor the legality of their marriage.

A certificate of matrimonial capacity is one of the documents that must be submitted with the marriage application.  This document proves that you are not already legally married or in a civil union in your country of origin.  The document states that the marriage shall be recognized in our country according to the Spanish marriage laws even if it is not well-known among Civil Registry officials.

In cases where the certificate of matrimonial capacity does not originate from a Spanish-speaking country, the applicant must submit the original certificate attached to a sworn translation in Spanish.

The foreigner may request such certificate in their country of origin or at their country´s consulate in Spain.  It must be duly legalized or apostilled.
